About these terms
These terms are an agreement between you and Baran Toppare, Avenue Charles de Gaulle 10, 13469 Berlin, Germany, the operator of CircleBell. By creating an account or using CircleBell, you agree to these terms.
Eligibility and accounts
You must be at least 13 years old, or the greater minimum age required in your country to use CircleBell on your own. If you are under 18, ask a parent or guardian to review these terms with you.
You must provide accurate account information, protect access to your device and account, and notify us at [email protected] if you believe your account has been compromised.
Using CircleBell
You may use CircleBell only for lawful, authorized purposes. You must not use the service to harass, threaten, impersonate, deceive, exploit, or harm another person; send unlawful or infringing content; interfere with the service; bypass access or purchase controls; automate access without permission; or attempt to gain unauthorized access to accounts, devices, or systems.
You are responsible for the content you submit and for choosing appropriate recipients. You must have the rights and permissions needed to submit that content and contact those recipients.
Not an emergency service
CircleBell is not an emergency service and should not be used when delivery or immediate attention is critical. A sent or accepted delivery status does not guarantee that a notification was displayed, heard, or read. Contact local emergency services through an appropriate telephone or emergency channel.
Your content
You retain ownership of content you submit. You give us a limited, non-exclusive license to host, process, transmit, and display that content only as needed to operate, secure, and support CircleBell. This license ends when the content is deleted from our systems, except where limited retention is legally or operationally necessary.
CircleBell Pro and purchases
CircleBell may offer monthly and annual auto-renewing subscriptions and a lifetime purchase through Apple’s App Store. The App Store shows the applicable price and billing period before purchase. Apple processes payment and manages billing, cancellation, and refunds under your Apple account and Apple’s terms.
Subscriptions continue and renew unless cancelled through your Apple account before renewal. Cancelling stops future renewals but does not normally refund the current billing period. A lifetime purchase provides access to the covered CircleBell Pro entitlement for the supported lifetime of the service; it does not guarantee that every feature or the service itself will remain unchanged or available forever.
You can restore eligible purchases from within CircleBell. Purchase availability and terms may vary by region.
App license and Apple
CircleBell is licensed, not sold. Your license to download and use the iOS app is governed by Apple’s Standard Licensed Application End User License Agreement. These CircleBell terms additionally govern your account, content, purchases, and use of the CircleBell service. Apple is not responsible for operating or supporting the CircleBell service.
Availability and changes
We work to keep CircleBell available, but the service may be interrupted, delayed, changed, limited, or discontinued. We may add, remove, or modify features where reasonably necessary to develop, secure, maintain, or comply with legal requirements for the service.
Suspension and termination
You may stop using CircleBell and delete your account at any time. We may restrict or end access when reasonably necessary to address a material or repeated breach of these terms, unlawful conduct, security risk, fraud, harm to others, or a legal requirement. Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.
Disclaimers and liability
CircleBell is provided with reasonable care and on an “as available” basis. We do not promise uninterrupted, error-free, or perfectly secure operation, or that every notification will be delivered, displayed, or noticed.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for intent, gross negligence, injury to life, body, or health, or mandatory product liability. Otherwise, liability is limited to losses that are reasonably foreseeable and directly caused by our breach of these terms.
Governing law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections you have under the law of your country of residence, and you may bring claims in any court available to you under applicable consumer law.
Changes to these terms
We may update these terms when CircleBell or applicable requirements change. We will provide reasonable advance notice of material changes when required. If you do not agree to updated terms, you should stop using CircleBell and delete your account.
